From the legislative point of view,Poland has a relatively developed public procurement system,though, as recorded above, further improvements remainnecessary. Since June 1994, when the Sejm passed the firstpublic procurement law,the law has gone through severalamendments with a view to incorporating the lessons learnedby the OPP and procuring entities. The law has been revisedagain in order to make it compatible with the EU procurementdirectives. It is expected that this revision will furtherimprove the transparency and competitiveness provided by thecurrent law. Furthermore, during the last five years,procuring entities in Poland, especially at the nationallevel, have acquired experience in implementing procurementaccording to the requirements of the public procurement law,and the Office of Public Procurement in supporting theseentities in their responsibility of conducting publicprocurement and in supervising the system. However, it hasbeen determined that in most cases the shortcomings relateto practice and only in a few cases to the deficiency of theprocedures. Therefore, while it is important to make the lawmore transparent and competitive, to realize savings inpublic spending, improvement in procurement practices needan even sharper focus. The areas to be addressed are:Provide good quality standard bidding documents. Introduceunambiguous and neutral technical specifications. Introduceobjective evaluation criteria. Separate evaluation ofbidder's qualification from the bid evaluation. Requirebid opening the same day as the deadline for bid submission.Allow adequate bid preparation time to bidders. Removebarriers to participation by foreign bidders. Requiremandatory post-qualification in the absence ofpre-qualification. Allow adequate time to procuring entitiesto spend budget allocations. Build procurement as a distinctprofession. Introduce two-tier procurement decision makingsystem. Introduce code of ethics for procurementprofessionals. Include provisions in the law suitable forprocurement of consultant services. Prepare a trainingstrategy and implement it. Improve bid dispute arbitrationprocedures. Introduce procedures for procurement under Euros3,000 to minimize the use of Sole Sourcing. Introduce bestpractices to procuring entities through the PublicProcurement Bulletin.
