【 摘 要 】

This report on the assessment of landgovernance in Brazil summarizes and discusses the results ofa series of standardized self-assessments of the landgovernance situation in Brazil, conducted entirely byBrazilian speakers. Therefore, these findings represent theperception of local experts based on their experience ofnews and data available. The main aim of this report arefederal and state authorities directly involved in landgovernance in the evaluated states and other states. Thegeneral objective of the development of this assessment isto measure reliably the skills and the performance of landgovernance in a cross section of the country. Thisassessment is highly relevant and timely, as the land andreal estate of natural resources linked to the land are thecentral core of the current competitiveness of Brazil andits strategically valuable position in the changing worldeconomy. The evaluation methodology was the AssessmentFramework of Land Governance (LGAF) developed by the WorldBank. It focused on five key areas of good land governanceand three additional topics. Key areas were: legal,institutional and associated policies to land rights;planning of land use and taxation; identification andownership of land management of the state; provision ofpublic land information; and dispute settlement. Theoptional modules used in some evaluations focused on thelarge-scale acquisition of land, forestry and theregularization of land tenure. Based on the LGAF in relatedworkshops and review of some publications, the review hasidentified four areas of relative force on the Brazilianland governance. They include the guarantee of propertyrights, transparency in allocation of public land, publicaccessibility of information on registered land andtransparency of increasing concern emerging from theinfluence of democratic and social movements. In addressingthese and other areas of reform of land governance, theefforts of the newly created Inter-ministerial Working Groupon Land Governance (IMWG) will be vital. That isparticularly so because some of the reforms depend on theconsistency of improving legal and institutional frameworkfor land governance, which is necessarily a collaborativeand cross-sector enterprise. This report therefore calls onthe IMWG to join the Presidents Office to create an annualand transparent work program, for a period of at least threeyears with a regular mechanism of agreed reporting to theIMWG Office and Civil Office of the Presidency.
