【 摘 要 】
The article sets out to demonstrate that the inclusion of social clauses in free trade agreements has a double effect: it involves the political sidelining of workers or employees as a unit, and it entails the watering down of a legal claim. In order to validate these hypotheses, two arguments are presented. The first offers an historical overview of the importance of the political decline of workers movements over the past two decades. And the second analyses the intrinsic nature of workers rights as collective rights, and shows how and why the State’s takeover of this right deprives a group of employees or workers of their collective claim.
