【 摘 要 】
The article offers an analysis of the conditions and obstacles to marriage established by law, the grounds for divorce and invalidity in the context of the manifestation of the cognitive and volitional function of the spouses' consciousness. It is proposed to appeal to the theory of marriage as a treaty prevailing in the science of family law, which, in turn, necessitated the study of marital relations with the participation of people with mental disorders, by analogy with transactions with viciousness of the subject composition, will and (or) will of the parties. A new category is a comprehensive study of mutual voluntary consent and attainment of marriageable age as legal conditions for marriage, the presence of which indicates that each of the married persons understands the purpose of marriage and the significance of their actions, as well as the ability to independently perform this legal act. A number of conclusions are formulated on the specifics of the construction of will and consent during the conclusion and dissolution of a marriage by persons suffering from mental disorders, but fully capable or recognized by the court as incompetent or partially capable.
