【 摘 要 】

The justice process for the crimes of State Terrorism in Argentina, Chile and Uruguay has important differences, but also notorious coincidences. One of the fundamental similarities is the delay in the judgment of differentiated violence towards women and people with non-heteronormative sexual orientations and/or gender expressions and/or non-cisnormative gender identities. Despite the extreme cruelty applied to their bodies, the prosecution of this kind of violence has not had the same progress as the rest of the events. In Argentina, only 12% of the sentences include crimes related to differentiated violence against women; in Chile, only a single conviction has recognized sexual violence against two women; and in Uruguay, despite the existence of a specific complaint since 2011, no responsible person has even been prosecuted. Violence experienced by people living outside of cis/heteronormativity is not being judicially investigated in the last two countries, despite numerous testimonies that demonstrate its extent. In Argentina, only the case of a transgender woman victim of State Terrorism is being investigated, but there was still no oral trial. This article compares what happens in the three countries and the common basis for these delays.
