【 摘 要 】

This article aims to present a deconstruction thesis of social rights underthe premise that the traditional theories of the origin and evolution of thesehave failings and shortcomings as to its position relative to fundamentalrights. In the the proposal presented, the dogmatic perception is presentedas the best measure for a reconstruction of social rights under a democratic,participative and transnational vision, in order to ensure their integrationand to reach a larger portion of society, especially at that most fragile, evenhaving to resort to the judicial nature of the rights guaranteed in the existingconstitutions, on the grounds of the existential minimum and preventingthe social regression.
