【 摘 要 】

This review is one of a series offunctional reviews commissioned by the Government of Romania(GOR), funded by the European Union, and carried out by theWorld Bank. It is an element agreed on by the European Unionand the Government as part of the post-accession Cooperationand Verification Mechanism (CVM) established to assessfurther need for reform in the judicial system and tosuggest reforms that would ensure Romania's fullintegration into the European Union system. The objective ofthe review is to analyze the functioning of institutions ofthe judicial system in Romania with a view to providinganalytical and advisory input to the Romanian authorities asthey formulate an action program to improve the performanceof the judicial system. The present report covers a largepart of Romania's judicial system, a term used herewith broad scope. In accord with the terms of reference(appendix one), in addition to the courts, the review coversthe Ministry of Justice, focusing on those functions mostdirectly related to the judiciary and to the Public Ministry(PM), the PM itself, and a range of independent legalprofessionals whose work complements and in some casesreplaces that of judges and prosecutors. Within thejudiciary, aside from the ordinary courts, the review alsoaddressed the operations of the Superior Council ofMagistracy, the Judicial Inspectorate, and the High Court ofCassation and Justice, all of which operatequasi-independently. They have their own budgets andadministrative structures, although are still governed bylaws on staffing set by Parliament and staffing levelsapproved by the cabinet. Within the PM, the team also lookedat the quasi-independent National Anti-Corruption Directorate.
