【 摘 要 】

Water is a scarce and finite resourcewith no substitute, and upon which the very existence oflife on earth depends. The challenges facing water resourcesare daunting. The Millennium Development Goals aim, interalia, at reducing by half, by 2015, the proportion of peoplewithout sustainable access to safe drinking water andsanitation. Although progress thus far is not encouraging,it is hoped that necessary actions will be taken to achievethis goal during the remaining period. Such actions includefinancial, institutional, and legal measures. Indeed,without the appropriate legal framework, the ability of thestate to regulate, control, and allocate its water resourcesis hampered; its role in ensuring their efficient and properuse is hindered; and its right to protect those resources ischallenged. This study of the regulatory frameworks forwater resources management examines water legislation insixteen jurisdictions, and highlights, in a comparativemanner, the key elements needed for an effective regulatoryframework. Chapter 1 traces the relevance and importanceassigned to water legislation by the different internationalconferences and forums, including the Mar del Plata, Dublin,and Rio, and the guidance provided by those conferences forpreparing such legislation. Chapter 2 surveys the regulatoryframeworks for water resources management in sixteenjurisdictions, based on certain key elements. Thosejurisdictions were selected based on the availability andaccessibility of a water law, as well as on the need torepresent different regions and legal systems of the world.Chapter 3 presents a comparative analysis of theseregulatory frameworks based on the same elements. Theanalysis examines the main similarities and differences inthe approaches adopted by the jurisdictions selected.Chapter 4 highlights essential elements that need to beaddressed in any regulatory framework for water resourcesmanagement, and identifies emerging trends in waterlegislation. Finally, Chapter 5 underscores the relevanceand importance of the regulatory framework, and specifiesconditions supporting its utility and efficacy.
