【 摘 要 】
This paper assesses the benefits, risks,and limitations of human rights based approaches todevelopment, which can be catalogued on the basis of theinstitutional mechanisms they rely on: global compliancebased on international and regional treaties; the policiesand programming of donors and executive agencies; rightstalk; and legal mobilization. The paper briefly reviews thepolitics of the first three kinds of human rights basedapproaches before examining constitutionally based legalmobilization for social and economic rights in greaterdetail. Litigation for social and economic rights isincreasing in frequency and scope in several countries, andexhibits appealing attributes, such as inclusiveness anddeliberative quality. Still, there are potential problemswith this form of human rights based mobilization, includingmiddle class capture, the potential counter-majoritarianismof courts, and difficulties in compliance. The conclusionsummarizes what is known, and what remains to be studied,regarding human rights based approaches to development.
