Services in the Trans-Pacific Partnership : What Would Be Lost?

【 摘 要 】

As the fate of the Trans-PacificPartnership (TPP) hangs in balance, an evaluation of what itoffers could inform current decisions and shape futurenegotiations. The TPP's services component has beenhailed as one of the agreement's major accomplishments.To assess the agreement’s impact on national policy in themajor services sectors, we created a new public database.This database reveals that TPP commitments seldom go beyondcountries' applied policies, suggesting the explicitliberalization resulting from the agreement is limited onlyto a few countries and a few areas. However, the TPPenhances transparency and policy certainty becauseparties' services commitments cover more tradingpartners, more sectors and are in some cases closer toapplied policies than their commitments under previousagreements. Furthermore, new TPP rules, including onstate-owned enterprises, government procurement andcompetition policy, could enhance services market access. Inparticular, the TPP breaks new ground in prohibitingrestrictions on international data flows, while at the sametime creating unprecedented obligations on all parties toprotect consumers from fraud and protect privacy. These dualobligations on importing and exporting countries represent amodel for regulatory cooperation that could elicit greatermarket opening if applied to other areas.
