Realizing the Devolution Dividend in Kenya through Cohesive Public Finance Management and Public Participation at County Level : Challenges, Lessons Learned, and Recommendations

This report covers four areas that hadbeen identified by County officers from both the CountyExecutive and the County Assembly as areas that have broughtconflict and disharmony in Counties. These issues andchallenges cut across Public Finance Management (PFM),public participation, functions and powers of the Countyactors and formed the basis for capacity building andtraining intervention that was provided through the Councilof Governors (CoG) and Kenya School of Government (KSG) withthe support from the Kenya Accountable Devolution Program(KADP). This brief report highlights the issues andchallenges identified in four thematic areas and thenprovides the identified good practices and lessons learnedthat can be considered and implemented by CountyGovernments. The first chapter discusses the PFM legalframework with reference to the fundamental processes ofplanning, budgeting, revenue, expenditure, and financialreporting and relates these to identified areas of conflictthat are experienced while executing various PFM processes.The chapter also makes corresponding recommendations forgood PFM practices in Counties. The second chapterhighlights the challenges that County Governments haveexperienced in rolling out public participation and providesconceptual clarification and examples of good practices. Thethird chapter highlights areas that were recurring areas ofmisunderstanding and misinterpretation with regard to theConstitution and legislative framework on devolution(especially relating to functions and powers of the CountyExecutive and County Assembly). Further, it articulates theConstitutional framework and interpretations of keyprovisions covering those areas of concern to facilitatecommon understanding that would help reduce recurringoperational disharmony and conflicts. The fourth chapterhighlights challenges that the County assemblies experiencewhile executing their responsibilities with regard to fiscalmatters and suggests good practices that should addressthese. This report is intended to be a simple, practical,go-to reference resource for County Executives and CountyAssemblies on common challenges that they experience whileexecuting their roles and responsibilities and suggests goodpractices that can help them navigate through the challenges.
