This report focuses on recommendationsfor the improvement of civil procedure rules and selectedtrial processes with the aim to increase proceduralefficiency and reduce bottlenecks in commercial caseprocessing in Bosnia and Herzegovina. The following aspectsof case processing are analyzed: (i) service of process;(ii) hearings and adjournments; (iii) expert witnesses; (iv)bankruptcy trustees; (v) court fees; (vi) internal courtrules; and (vii) use of Case Management System (CMS). Theaccompanying recommendations are developed in response tothe existing legal framework that governs these selectedaspects of commercial case processing and rely on existinggood examples from Bosnia and Herzegovina courts, theregulatory framework of countries that share the same legalheritage as Bosnia and Herzegovina with a particular focuson European Union and Council of Europe member states, theEuropean Court of Human Rights (ECtHR) case law, as well asrecommendations and opinions of international institutionson judicial efficiency.
