Micro, small, and medium enterprises(MSMEs) are among the largest commercial users of insolvencysystems. MSMEs are a significant part of the global economy– and just as there are large numbers of MSMEs, there arelarge numbers of MSME insolvencies. However, there are avery few specialized legal regimes for MSME insolvency; mostjurisdictions treat MSME insolvencies the same as for othercorporate entities, or conversely, natural persons, despiteMSMEs'unique attributes. This report considers thespecific challenges of insolvent MSMEs (including thedifficulties of defining MSMEs and distinguishing them fromlarge corporate entities); reviews and analyzes howlegislation in different jurisdictions deals with thechallenges of MSME insolvency; and considers if existinginternational standards are sufficient to address MSME insolvency.
