【 摘 要 】
In Ruan v. United States, 142 S. Ct. 2370 (2022),the U.S. Supreme Court determined that the 10th and11th Circuit Courts erred in affirming jury instructionswith a negligence standard for the prosecution of twophysicians under the Controlled Substances Act(CSA), 21 U.S.C. § 841 (2018). The Court foundthat the state must prove beyond a reasonable doubtthat the physicians knowingly wrote prescriptions without a legitimate medical purpose. The holding establishes a new mens rea standard for CSA physicianprosecutions.
