Commonwealth of Kentucky, 614 S.W.3d 915 (Ky. 2021), the Supreme Court of Kentucky reviewed the standards by which parental substance abuse could be regarded as child neglect. A family court, citing a report of alcohol use and treatment noncompliance by M.C., removed his children. An appellate court affirmed. The high court reversed for lack of findings of incapacity per Kentucky statutes and case law.
