【 摘 要 】
This work analyzes the position of head of state in constitutional norms of two Serbian constitutions (from 1888. and 2006), and the description of the practice ('live' constitution), which is formed under these two constitutions. On that way, in the work is compared and evaluated the position of the king and the president of the republic, that is the two forms of government - monarchy and republic. Through a review of the current constitutional moment, it could be concluded if the republic form in Serbia has an alternative to the monarchy whatsoever, and what would be the advantages and disadvantages in connection with possible change of the form of government. In this sense, the subject of analysis is, primarily, the constitutional position of the head of state. It includes the model of election, the beginning, duration and termination of function, jurisdictions and relationship with other public authorities. In the evaluation of the practical political power, especially important is the relationship between the head of state, as the representative of the whole nation, and political parties.
