【 摘 要 】

Объектом исследования явилась система правового обеспечения управления прямыми иностранными инвес­тициями в Республике Молдова. Изучено влияние метода налогового освобож­дения и метода налоговых креди­тов на привлечение различных типов прямых иностранных инвестиций в Республику Молдова. Автор выявляет наиболее и наименее эффективно работающие соглашения в контексте привлечения прямых иностранных инвестиций в Республику Молдова. В результате проведенного анализа даны рекомендации по необходимости заключения Республикой Молдова договоров об избежании двой­ного налогообложения и двусторонних согла­шений о поощрении и взаимной защите капиталовложений с определёнными странами.

ASIGURAREA JURIDICO-LEGALĂ A GESTIUNII INVESTIȚIILOR STRĂINE DIRECTE ÎN REPUBLICA MOLDOVA

 

Obiectul de cercetare în acest articol este sistemul asigurării juridico-legale a procesului de gestiune a inves­tițiilor străine în Republica Moldova. Este examinată influența metodei scutirii de impozite și a metodei creditelor fiscale asupra procesului de atragere a diferitelor tipuri de investiții străine directe în țara noastră. Autorul determină acordurile  eficiente și mai puțin eficiente în vederea atragerii investițiilor străine directe în Republica Moldova. În urma analizei efectuate autorul înaintează recomandări care accentuează necesitatea incheierii de către Republica Moldova a unor acorduri cu anumite state, ceea ce ar permite evitarea dublei impuneri, precum și a acordurilor bilaterale cu privire la siguranța investițiilor străine directe.

LEGAL ENVIRONMENT FOR FOREIGN DIRECT INVESTMENT MANAGEMENT IN THE REPUBLIC OF MOLDOVA

This article examines the system of legal environment for foreign direct investment in theRepublicofMoldova. Mainly it focuses on such international legislative acts as double taxation and bilateral investment treaties concluded between theRepublicofMoldovaand the other countries. The paper presents the impact of tax exemption and tax credit methods on attracting different types of foreign direct investment in theRepublicofMoldova. The author has defined the most effective and most ineffective double taxation and bilateral investment treaties for theRepublicofMoldovain the context of FDI attraction. As the result of the analysis author has specified the countries to conclude the double taxation and bilateral investment treaties in future.
