【 摘 要 】

This study mainly aims to determine whether the Regulation 1206/2001 on cooperation between the courts of the Member States in the field of obtaining evidence in civil and commercial matters is imperative, mandatory or not, and/or exclusive. The clarification of the nature of the Regulation is essential for uniform application of these rules of Private International Law in the European Union by all Member States. The recent bringing of two cases on this issue before the Court of Justice of the European Union underlines the importance and timeliness of this complex issue.
