【 摘 要 】

This article aims to examine in the ambit of decision theory the treating the new Code of Civil Procedure gave the exam of balancing in case of standards collision situation. The meaning of this article is to answer the question: what motivated, what is the purpose and what to expect of §2º, do art. 489, do NCPC? To achieve the goal, the study faces some of the main criticisms of the legal provision and provides interpretation of your application and challenges.
