L’anthropologie et le droit dans les conflits historiographiques de l’Angleterre prémoderne : l’exemple du Philadelphus de R. Harvey (1593)

【 摘 要 】

R. Harvey was an english astrologist. He lived in the 16th century and has remained quite unknown as an author. Nevertheless, he was the first one to use the word “anthropology” (Philadelphus, 1593). This article shows that this word must be taken seriously in Harvey’s text and that “anthropology” – defined by Harvey as a part of a method to discover the past – has to be related to law. In this text, law and anthropology are closely linked because Harvey’s relationship to the past has something to do with law and justice on the one hand (method), and because nobility is here defined by justice on the other hand. A thread can then be drawn between this idea of nobility and the famous “Birthright of Englishmen” forged by the common lawyers to defeat the royalists of the following century.
