【 摘 要 】

Definition of the subject of the research: (Al-Sarqifliyah) the amount of money paid by the person to the real estate user in return for the latter's waiver of his right to use it. Al-Sarqifliyah is one of the important transactions that have spread among people, especially among traders and investors, whether they are owners or tenants. Second: The reasons for choosing the subject of the research: Due to the importance of the subject and its spread in terms of the daily dealings between people and the resulting exploitation and loss of rights from one hand, and on the other hand, Al-Sarqifliyah is a matter in which opinions and judgments differ, especially about its cases and the ruling of each case. Therefore, we have seen the need to determine the legal and legitimate rule of this issue in all its different situations. As the shops, especially the markets today, suffer from the problem of the foreign exchange rate, because it is one of the reasons that lead the trader to put a high profit on consumer goods to pay the expenses paid for overpayments of Al-Sarqifliyah, which is a negative impact on the prices of goods and work on the rise and bear the consumer part of the burden of this rise in prices
