【 摘 要 】

This study aims to realize an approach about the origin of the judicial review, to analyze, critically, the historical and political meaning of Marbury vs. Madison case, as the period that precedes it. This analysis aims to demystify the initial parameter. In addi- tion, there will be a detailed investigation into the decisions of the Supreme Court (STF) on the effects in space with respect to judicial review, notably about the transcendent aspects, binding and erga omnes of judgments.
