【 摘 要 】

This essay introduces a critical reflection with regard to barriers related to eff ectiveness andrespectthefundamentalrighttopersonalidentity-institutionalizedchildrenandadolescentswhobecauseofadverseconditions–thatis,orphanhood,violence,abuse,neglect or poverty – are separated from family life and brought to live in institutions public or private. From the contribution of national and foreign authors on the subject, will seek to promote a discussion about the social validity of the paternal set of rules available to the very personal rights and told the precariousness of the Institute of institutional old host, its objective and subjective refl ections on the construction of personal identity and the process of stigmatization of these children and adolescents as an ominous reality of our time, from information obtained during the course of conducting fi eld research, as the fi rst phase of a project fi nanced by FAPERJ entitled: Housing: Necessity or neglect? Citizenship known since childhood is the basic pillar for social justice.
