Patronage over justice: In relation to the working draft of the amendment to the Constitution of the Republic of Serbia

【 摘 要 】

The author presents the content of new solutions in the working draft of the amendment to the Constitution of the Republic of Serbia, which was published on January 22, 2018 by the Ministry of Justice. He points out to the negative reactions of the experts. He critically analyses particular solutions, election and manner of decision making of the High Judicial and State Prosecutorial Councils. The author concludes that the working draft deviates also from international legal standards and from the Strategy and Action Plan for the Reform of Justice, proclaimed by both legislative and executional powers in Serbia. He believes that working draft of the amendment shall be considered as radicalization of the attempt of these two governmental powers, embodied in political parties, to preserve the patronage over justice.
