【 摘 要 】

This study examines the conditions for universal protection of the right to have rights to belong to a state and never be deprived of its protection. It is a fundamental and universal right of the individual whose protection requires the intervention of the “concert of nations”. If Hannah Arendt, her designer, believes that this right must be guaranteed by international agreements, we believe that these agreements are insufficient to translate and guarantee its universality. To do so, it would have been necessary to put it in the jus cogens in order to protect it from the individual wishes of the States. This work aims to show possible avenues for the liberation of the right to have rights of national sovereignty.
