【 摘 要 】

El derecho de retención ha sido una garantía controversial a partir de su naturaleza forzada y atávica. En este trabajo se entregan los lineamientos necesarios para avanzar hacia su reconocimiento general, dejando atrás su carácter legal y excepcional, dotándolo de una mayor eficacia, a través de una acción restitutoria, una eficacia erga omnes y la realización y privilegio de la cosa para el pago del crédito conexo, asociado a los límites usuales del enriquecimiento a expensas de otro y el principio de la buena fe.
Retention has been historically a contested guarantee. This paper intends to provide some general orientations required to move forward to its general acceptance, leaving behind its legal and exceptional nature; furthermore giving it more strength trough a restitutory action, an erga omnes effect and acknowledging the creditor a stronger position regarding the payment of her related credit, limited, as usual, by unjust enrichment and good faith.
