【 摘 要 】

This paper is a critical reading of the three precedent articles, especially of the legal reasoning approach adopted on the issue of the commons in Italy. By examining the political experience of the commons and comparing it to other contemporary democratic movements in Europe, this paper argues that the critical potential of this concept and these experiences is political, rather than just legal. The main point of these movements is the renewal of radical democracy, the related legal developments being just one specific aspect of this renewal.
