【 摘 要 】
The paper analyses racial profiling in stop and frisk based on Terry v. Ohio (1968) and Floyd v. City of New York (2013). The deffense of stop and frisk as a tool of crime repression and of war on drugs is debated. Floyd ruling is then analysed, in which it was acknowledged that NYPD has implemented unreasonable and racially directed stops and frisks between 2004 and 2012. It is argued that judicial scrutiny plays a central role towards the reduction of institutional racism reproduced by police.
