【 摘 要 】

Identifying the legal nature of the institution in question, as with all institutions of criminal law, provides the best opportunities to judges, prosecutors, lawyers, all those involved in the administration of justice, in the law enforcement business to adopt rigorous and thoroughly documented solutions. Previous research on the subject is reduced. In the present study we combined the study of legal texts with the doctrine study, all related to the current reality. Material findings are relevant for both theorists and practitioners of the Romanian criminal law.
