【 摘 要 】
The environmental agenda presents challenges to old assumptions concerningPenal Law. The modern age brought indefinition and unstablenessthrough broadened concepts of liability, damage and offensiveness. Thisfresh scenario required nations to provide proper response to causes neveraddressed before. Therefore, Environmental Criminal Law became visible,since continual transgressions and non-compliance were jeopardizing itsmajor legal asset. The United States of America and Japan, nations withdistinct social evolvement and history, employ Penal Law as the key to envi-ronmental violations, although peculiar outcomes have emerged in each country. Nevertheless, the demandfor criminalization depicts frames of civic education and the essentiality of effective resources to strengthencollective ties among individuals. Laying the groundwork on deductive reasoning and comparative analysisof both legal systems and public data �? American and Japanese �?, the juridical dogmatic alignment of thispaper was chosen in order to offer inputs regarding the encouragement of Administrative and Civil Law byCriminal liability.
