Lei natural e justificação política em Locke

【 摘 要 】

Resumo John Locke forneceu nos Dois Tratados sobre o Governo razões para os cidadãos rejeitarem o direito divino dos governantes e crenças que possibilitaram aos cidadãos resistirem ao governo tirânico. Tais crenças e razões estão contidas no argumento lockiano da lei natural, promulgada por Deus à razão dos homens e que serve de base para os termos do contrato que institui a sociedade civil. Não obstante, ela ainda permanece como ordem valorativa à qual os cidadãos recorrem para seus julgamentos e ações na esfera política. John Rawls (2007), séculos mais tarde, reconhece que Locke possui uma concepção de justificação política ao sustentar uma ordem independente de valores que também permitem avaliar juízos políticos. No entanto Rawls não examina amplamente a lei natural sob esse prisma, o que suscita o exame aqui proposto sobre as funções e os limites do argumento da lei natural como ordem valorativa.Palavras-chave John Locke, lei natural, valores morais e políticos, John Rawls, justificação. Abstract John Locke provided in Two Treatises of Government reasons for citizens reject the divine right of rulers and beliefs that enabled citizens to resist against the tyrannical government. Such beliefs and reasons are contained in the argument of Lockean natural law, enacted by God to men’s reason and that is the basis for the terms of the contract establishing civil society. Nevertheless, it still remains as value order which citizens rely for their judgments and actions in the political sphere. John Rawls (2007), centuries later, recognizes that Locke has a conception of political justification to sustain an independent order of values ​�?�that also allow to assess political judgments. However Rawls does not examine natural law largely through that prism, which raises the examination proposed here on the functions and limits of the natural law argument as value order.
