【 摘 要 】

The compulsory drug treatment based on Law No 10.216 of 2001 promoted by the town of Rio de Janeiro while public health policy or hygienist measure is the subject put in debate from the analysis of the fundamental right to health and public health policies determined by the Federal Constitution under the jurisdiction of the Brazilian Public Health System, of the recognition of addicts as people with mental disorders and referred state policies of health brought by the Psychiatric Reform Law, as well as, the internment operations adopted by the municipality of Rio de Janeiro for addicts in areas of “cracolândia�? under the Protocol of Specialized Social Approach.
