【 摘 要 】
The aim of this paper is to analyze the judicial activism related to the constitutional right to health together with the Executive Branch’s constitutional competence to create public policies of health and to plan governmental actions. Each Political Entity in the Brazilian Federalism makes use of planning instruments, reckoned in the Federal Constitution, to elaborate their plan of governmental actions. One of these instruments is the Annual Budget Law, which forecasts every public incomes and expenses for a whole year in order to develop governmental actions planned. However, there is an increasing number of judicial decisions compelling the Executive Branch to grant medicines and medical treatments on individual lawsuits. This reality may threaten the government’s budget since the Judiciary Branch imposes unforeseen expenses on the Executive Branch’s planning. Therefore, it can be inferred that excessive judicial activism can lead to a negative impact on the execution of public policies of health and produce harmful effects on the principle of the separation of powers.
