Moldando a “reserva do possível�? no tempo: a sustentabilidade fiscal como direito difuso fundamental

【 摘 要 】

The article aims to outlook the understanding of fiscal sustainability as a fundamental right. The budget constraint of the public sector is deemed a factual and formal limit to fundamental socio-economic-cultural rights achievement. Government debt is the tool which allows to shape the “proviso of the possible�? over more than one financial year, anticipating the spending of public funds. However, its unsustainable dynamics carries serious consequences for the whole society. The article identifies an additional view and typifies fiscal sustainability as a fundamental right from surveying its violation consequences, analyzing the characteristics of a group interest, and extracting its protection duty from constitutional principles and rules. The study concludes that the time limit to socio-economic- -cultural rights achievement, rather than budgetary legislation or creditors�? rights, is the present and future generations�? group right of not suffering the consequences of an unsustainable public sector financial activity. Taking fiscal sustainability as a right, instead of just a desirable goal, contributes in assessing of what someone can reasonably demand from society.
